1. General provisions

This "Client Agreement - General Terms and Conditions of TEMPO France" (hereinafter referred to as the "Agreement") is applied and controls your access to TEMPO France’s website, as well as the services that are available on this website and used by you.

Consequently, visiting this website, both anonymously and as an "authorized user" (with the help of an identification login and password) and using the online services offered by TEMPO France (by the way of both simply consulting and efficiently using them), you acknowledge that you have read and accepted all the terms and conditions, which are present in this Agreement.
Therefore, Tempo France asks you to very carefully read this Agreement and make sure you understand its content well and only then use the services offered on TEMPO France’s website, including submission of online-requests for money transfer (hereinafter referred to as the "e-transfers").

This Agreement implies restrictions on the obligations of TEMPO France in your respect, as well as restrictions and release of liability of TEMPO France in your respect, in particular, in case you suffer inconveniences as a result of using the services offered by TEMPO France.

It is specified that the original text of this Agreement is made up in French, and that its French version prevails over all other versions translated into other languages (English, German, and Russian). In this case, all such other versions are provided solely for information purposes.

Note:

a. If you refuse to accept any provisions and/or terms of this Agreement, you will not be able to use the services offered by TEMPO France.

b. Due to the fact that registration and/or use of the online-services offered by TEMPO France requires acceptance of this Agreement, we strongly recommend you should keep its copy (as a digital document on your device or by printing it out on a paper medium).

2. General information on Tempo France

TEMPO France is:

- a simplified joint stock company established in accordance with the legislation of France,  owning the share capital in the amount of 1,500,546.20 Euros, registered in the Paris Commerce and Industrial Register (under number B 508 415 676), whose office is located at 89 Boulevard de Magenta - 75010 Paris (France),

- a payment establishment duly accredited by the State Commission of the Banking Service Financial Regulation and Supervision (ACPR) of the Bank of France, with assignment of Interbank Code 16418W.

The principal activity type of TEMPO France implies transfer of funds at the international level either during your personal visit to the office of TEMPO Agency and direct payment of funds through a cash-office, or through one of the agents authorized by TEMPO France, or via online-transfer service.

3. Presentation of the website and service offered on the website

The website allows for submitting online fund-transfers ("e-transfers"), in addition to the services offered mentioned above (including tracking requests, actual currency rates in real-time mode, etc.).

To send a transfer request electronically (perform an e-transfer), or use a service related to this request, the user will be identified on the website by creating/using their personal account (with the help of a login and password), which enables them to create and track their request without having to personally visit TEMPO Agency in Paris, or one of the authorized agents.

4. Regulatory compliance – Registration - Acceptance of general terms

The below-stated specifications refer to all types of money transfers: any money transfer submitted online and any request submitted during a personal visit to TEMPO Agency in Paris or one of the agents authorized by Tempo France.

To access the services offered by TEMPO France and be able to sign in for their use, you shall be at least 18 (age of majority under the French law), and you shall possess a legal capacity to enter into contractual relationship.

Being an individual, you represents and warrants TEMPO France that you have reached the least required age, possess a legal capacity to enter into an agreement and use services offered by TEMPO France solely on your own behalf (you do not act on behalf of any secret trustee or third person).

To confirm your registration and before you start using the services, TEMPO France reserves the right to verify your identity.
You may be requested to provide proof of your identity, in the form of one or several valid national documents, which must bear your photo, and which were issued by duly authorized government bodies (a passport, an internal ID certificate, a residence permit, etc.).

You may be requested to provide TEMPO France with these or other proof of ID, by any available means (during your personal visit to the agency, by transferring it via the website by a specifically-provided method, by fax, e-mail, courier service, etc.).

TEMPO France may, at its own discretion, conduct a computerized audit of your electronic identification data and reserves the right to send corresponding requests to various national bodies and private databases for the purpose of confirming or rejecting the information provided by you. Any data on any suspicious individual or their activities may be transferred to corresponding competent authorities, in particular, to the French authorities specializing in fraud prevention.

This verification procedure corresponds to France’s regulatory and legal requirements, and is required for establishing good client relations with Tempo France. Nevertheless, the duration of such a verification procedure varies, which can lead to certain delays in your initial request processing. Tempo France is not responsible for any such delays.

TEMPO France reserves the right to deny you registration as a new user, or deny your transfer request, if certain data provided by you seem erroneous, falsified or are in violation of Tempo France’s anti-fraud policy.
In case any doubling accounts of users (the so-called duplicates) are revealed, TEMPO France reserves the right to close the second account opened later or unite such doubling accounts into one account without sending any preliminary notification to this user for the purpose of security and identification of its users.

We recommend that you keep your login and password observing special measures of personal data storage and confidentiality preservation as it is only you who are responsible for their security; and in case this information is disclosed due to your fault, Tempo France assumes no responsibility.
In case you have forgotten or lost your registration data, you can contact TEMPO France and pass a special verification procedure (for example, by checking you previously given answer to a secret question that is determined in advance) to recover an access to your account. Nevertheless, we strongly advise you against creating a new account in case you have forgotten or lost the data of the old one (due to the risk of a duplicate and unexpected closing of the second account).

Your simple access to TEMPO France’s website, registration for receipt of the offered services and their use is implied by your acceptance of this Agreement, including all its terms and conditions.

5. Personal data - Confidentiality - Private life confidentiality

The below-stated specifications refer to all types of money transfers: any money transfer submitted online and any request submitted during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.

To get registered as a user of  TEMPO France’s websites, you have communicated TEMPO France your corresponding personal data.
This data is subject to computerized processing and transfer to the competent bodies of France for the purpose of verifying your identity, as well as to controlling bodies who govern the activities of TEMPO France.

6. Fraud prevention

The below-stated specifications refer to all types of money transfers: any money transfer submitted online and any request submitted during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.

TEMPO France strives to protect its customers against any fraudulent activities and other illegal and criminal operations. However, though it deals with prevention of fraudulent activities, it is the customer who should do their best to minimize them.
The victims of numerous fraudsters are such people as you: people who work every day fingers to the bone in Western Europe and want to provide financial support to their relatives and friends in their country of origin.

TEMPO France is in no case willing you to fall a victim of such fraud and lose a part of your funds you have been saving for so long, day after day.  Therefore, when you transfer funds with the help of the services offered by TEMPO France, you may be asked certain questions, which in some cases enable TEMPO France to warn you about the existence of certain types of fraud risk. But you should be careful yourself.
Herein, you can review two types of circumstances, by which you should not use the services offered byTEMPO France or its competitor to send funds:

a. You do not known the recipient personally if:

  • You are told that you won a prize or received a gift, loan or other valuable item but at first you should send a payment. Sometimes this payment is described as an amount required to cover transportation expenses, customs duties, document processing costs or taxes. Please, note that such an unexpected award is fabricated as you cannot win a prize if you do not participate in a contest, neither can you receive a loan if you have not applied for it.
  • Someone sent you a check for the amount exceeding the amount owed by that person to you, besides, this check could be issued by a person other than that who owes money to you. If any person asks you to return any additional funds to it, immediately contact the supposed author of this check (based on the names and addresses specified on it) to inform he/she that you are going to destroy this check (which can be falsified and cannot be cashed), then ask him/her to send you a new check with the correct amount, and/or again directly contact the person who owes money to you if the check is not issued by him/her and ask him/her to send you the exact compensation amount in accordance with the debt sum.
  • Someone promises to deposit funds to your bank account and ask you to preliminarily return a part of the funds that exceed a certain amount. Please, note that the promised amount will never come to your account.

In any case, it probably deals with fraud. You will not receive what you are promised to and will lose your money forever.

b. Someone asked you by e-mail or via text message to urgently send funds to a person you know, except for those cases when you talk to this person or his/her relative or close friend you know personally in voice (make sure there is actually an emergency situation).
This type of fraud is often the case. It is as if your mother, nephew, cousin, etc. or even a friend required urgent medical aid, or they found themselves somewhere without documents, funds and cell phone, or they were kidnapped. Check it up first. It is most likely that your relative or friend is alright, and the funds sent for the alleged urgent aid and without checkup will be transferred to the fraudster's account.

Besides, never provide your personal financial data (number of your bank account or credit card) to any third person if you do not know who is requesting them and are not sure of his/her identity. If you are asked to confirm you financial data online, do it only after confirming the request by your account manager.

TEMPO France will always help you and take all the required measures to transfer information on the fraudster who tried to capitalize on your confidence to the competent bodies.

Even if you have revealed that your fell a victim of the fraudster and sent them funds with use of the services offered by TEMPO France, please, immediately contact TEMPO France’s Customer Support Service by phone or e-mail as it is the speed of your actions that determines the promptness of our response. If still possible, TEMPO France will block the transfer of the funds sent to the fraudster.

7. Methods of providing services, including online-transfers

By creating/using your personal account, you use personified services during your personal visit to TEMPO Agency in Paris (or to the agents authorized by TEMPO France) to perform a money transfer.

On this website, you can also learn the valid currency rates, review the commission amounts, which will be displayed on the screen when a desirable transfer amount is entered, track a money transfer with the help of an individual request number (a request number is issued when submitting a money transfer request, either when personally visiting Tempo Agency in Paris, or one of its authorized agents).

All the information related to currency rates, commissions and status of your requests is provided in real-time mode and remains relevant the entire period you are visiting the website.

Your familiarization with this information at any particular moment does not imply any responsibility on the part of TEMPO France for what will happen in the future.

Such information reflects solely the situation that exists at the given moment. You should note that the situation may only change and cannot remain the same at all times. Therefore, TEMPO France assumes no responsibility for any of your actions, based solely on the information obtained from its website.

The terms for sending online-requests for money transfers ("e-transfers") are provided below.

You should get identified by creating/using a user account (with the help of a login and password), which enables you to fully use the services of e-transfers, review the history of your transfers, track your current transfers in real-time mode or access other numerous data (for example, access data of your user account or change them).

Before performing e-transfers of funds, it is required to create a personal user account. Once your registration is confirmed by TEMPO France (see Article 4 of this Agreement), you are granted an access to your user account and can get to processing of an e-transfer request.

To ensure the highest possible quality when processing your request, we ask you to provide numerous personal data relating to the recipient (his/her full name, address, phone number or e-mail address, banking details, if necessary, etc.) depending on the fact what method of money transfer to the recipient you select. [Note: this condition is also important when you submit requests for money transfers during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.]

Further, you should specify the transferred amount taking into account that the commission can vary depending on the method of payment of the transfer to your recipient. In France, the transferred amounts are cashed in Euros or converted to US dollars or local currencies depending on the fact what options are available in every country. [Note: this condition is also important when you submit requests for money transfers during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.]
The valid commission rates of TEMPO France are provided in Art. 9 hereof.

Once you have confirmed your online-request for money transfer and simultaneously accepted this Agreement (opt-in), TEMPO France sends you a document containing all the data required for processing your request (for example, in the form of an electronic confirmation e-mailed to the address you specified in the user parameters).

Please, remember that at this stage it deals only with the request on your part. TEMPO France will pass to processing of the request only once it receives your funds for performing a transfer to your recipient. You are obliged to provide funds to TEMPO France by any method that is convenient to you with due diligence. TEMPO France is not responsible for any delayed transfer of funds in TEMPO France.

Your request will be processed within a reasonable period (for example, on the next business day following the accrual of your funds) as soon as TEMPO France receives a confirmation from the bank that your funds are accrued to the account. [Note: this condition is also important when you submit requests for money transfers during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.]

The function of money transfer tracking, which is present in your user account, will enable you to regularly view various stages of processing of your money transfer request by TEMPO France.

8. Limits – Restriction and suspension - Transfer blocking - Actions of third parties

The below-stated specifications refer to all types of money transfers: any money transfer submitted online and any request submitted during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.

a. Limits of transferred amounts

As any other company providing the money transfer services, TEMPO France applies the limits of transferred amounts within a certain period.
The company applies the following limits:
- The highest possible amount of a single money transfer makes up 5,000 Euros;
- The highest possible amount of all transfers for 30 days makes up 5,000 Euros;
- The highest possible amount of all transfers for 90 days makes up 8,000 Euros;
- The annual total limit for money transfers makes up 20,000 Euros.

In connection with certain money transfer requests recurrently sent by the same user or to the account of the same recipient (by several users simultaneously), you may be asked to provide additional data on the origin of funds for further processing the next transfer request.

If your transfer request, both individually and jointly with the recently performed transfers, has reached one of the limits set by the controlling body, TEMPO France will ask you to either provide any confirming documents for such a transfer or subsequent transfers, and only then proceed to the money transfer transaction; or wait for a particular period (depending on the reached limit) to be able to submit a new request. In any case, TEMPO France is not responsible for any consequences of such a situation.


b. Restriction and suspension of transfers to certain countries of the recipient

The possibility of performing a money transfer to the country of the recipient can be sometimes restricted or suspended for different reasons not depending on the commercial offer or will of TEMPO France. In particular, it can be related to any regulatory reasons concerning the control of changes or prohibitions imposed by new provisions within the framework of the struggle against money laundering and financing of terrorism.  In any case, TEMPO France is not responsible for such a restriction or suspension, which led to the change, including cancellation, of your initial request.

c. Transfer blocking

TEMPO France reserves the right to block a transfer.  Acting in accordance with the obligations stipulated by the French legislation and controlling bodies, TEMPO France shall observe the legal provisions related to the struggle against money laundering and financing of terrorism, as well as restrictions by performing financial transactions related to politically vulnerable persons or being an object of asset freezing measures.

For the purpose of compliance with its legal obligations, TEMPO France uses the software that automatically compares your name and the name of your recipient with the names that are included into the official lists provided by the authorities to it.
It is often the case that the specified software blocks a transfer due to, in particular, an accidental similarity between the name of the customer or his/her recipient and the name included into one of these lists, which can lead to an immediate delay of the requested transfer until it is not duly audited by the internal compliance service of TEMPO France, which will further decide upon a possibility of this transfer authorization.

In this case, you will be asked to provide additional data or documents to unblock your transfer request. How fast you provide the required data will determine how quickly your request is processed. In any case, TEMPO France is not responsible for any additional delay caused by such a situation.

d. Illegal actions of any third parties

TEMPO France assumes no responsibility for any direct or indirect consequences of illegal actions of any third persons.
In particular, it deals with any action resulting in non-performance of your transfer request.

For example: (1) your bank did not transfer funds to TEMPO France with due diligence; (2) your Internet service provider and/or web-browser suspended an Internet access before the transaction completion; (3) your Internet service provider and/or web-browser delayed or blocked your message to TEMPO France or the message of TEMPO France to you; (4) any virus transferred by any third person compromised the security of your personal data and transfer requests during your visit of TEMPO France’s website; etc.

9. Valid commission rates

The amount that will be transferred to your recipient is specified as a net amount, without any commissions.
The monetary commissions charged by TEMPO France vary depending on the transfer amount, method of money transfer for further accrual to TEMPO France, which is selected by the customer (in cash or by depositing to the bank card), place the money transfer is issued to the recipient, bank or another payment establishment selected by the client for money transfer performance to the recipient, whether it is required to convert funds into another currency, and other various factors.

a. If you send your request during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.

The valid commission rates of TEMPO France and all information related to the applicable currency rates are available in TEMPO Agency in Paris or by one of the agents authorized by TEMPO France.
TEMPO France provides you with this information in a clear and unambiguous way before you send your request. It is also specified in the receipt (received in the cash-office), which shall be signed by you for processing your request.

b. If you submit your online-request on the site TEMPO France

The valid commission rates of TEMPO France and all the information related to the applicable currency rates are specified automatically in real-time mode in a clear and unambiguous way during the entire period of your request processing.
This period is certainly limited in time for information security reasons: your request shall be processed during the provided reasonable period (for an average computer user); otherwise the data entered by you will be deleted as a result of forced disconnection with the TEMPO France services, so you will have to submit your transfer request again.

In any case, the valid commission rates of TEMPO France and currency rates applied to your transfer request are specified in the document issued by TEMPO France for your request with a certain validity period.

10. Walkaway (cancellation of the transfer request)

The below-stated specifications refer to all types of money transfers: any money transfer submitted online and any request submitted during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.
You can cancel your transfer and demand to return the funds, without commissions, providing that your transfer request is not at the closing stage (if funds are being granted or have already been granted to the recipient).
To cancel your transfer request, which has not yet been processed, you should confirm your identity at TEMPO France (for the purpose of compliance with the security and identification requirements) and provide evidence of your request authenticity (the document issued by TEMPO France for your request).
As for the return of your funds (it deals with the funds, without commissions), TEMPO France is not responsible for any errors, violations or delays beyond its control.

11. Terms

The below-stated specifications refer to all types of money transfers: any money transfer submitted online and any request submitted during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.

If your request is processed in accordance with the established procedure, funds as a rule are transferred by TEMPO France within very short periods. Nevertheless, TEMPO France cannot guarantee that your recipient will receive funds within a certain period.

The money transfer mainly depends on the working schedule of a corresponding payment establishment, which performs payment of funds to your recipient, as well as on a method of payment to the recipient (the method you specified in the transfer request).

There are the following payment options:

- Receipt in cash by the recipient in the cash-office of a corresponding payment establishment,
- Depositing the transferred funds on the bank account owned by the recipient.

Nevertheless, for the following countries (Vietnam, the Philippines and the Dominican Republic), there are the following possible payment forms:

- Receipt in cash by the recipient in the cash-office of a corresponding payment establishment.
- Depositing the transferred funds on the bank account owned by the recipient.                                                                                                                             - Delivery of the transferred funds by courier to the residential address of the recipient.

The transferred funds are provided to your recipient (without commissions) by a corresponding payment establishment, whose data were specified when you submitted your request, and are present, in particular, in the document issued by TEMPO France to you (it deals with a document containing all the information included in your initial request).

The period for providing the funds to your recipient is up to thirty (30) days: if the money transfer was not paid by a corresponding payment establishment to your recipient, the transfer is canceled and the funds are returned according to a special request submitted by you to TEMPO France, providing that you confirm your identity (for the purpose of compliance with the security and identification requirements) and provide evidence of your money transfer request authenticity (a document issued by Tempo France for your request).

If funds are received in cash, the recipient shall provide a valid document confirming his/her identity and specify a number of the request for a corresponding transfer, which is specified in the document issued by TEMPO France as a confirmation of successful processing of your request, in a corresponding payment establishment.

In case of a wire transfer of funds to the recipient, you shall provide TEMPO France with the exact banking details of your recipient.
Please, make sure the banking details of your recipient specified in the field specially provided for this purpose when making your money transfer request online, are correct; if necessary, double-check the entered data to avoid any mistakes. In case of any mistake made by you when entering data, TEMPO France assumes no responsibility in case the money transfer is received by a recipient other than the individual whose banking details you specified in the request.

12. Principal obligations and responsibility

The below-stated specifications refer to all types of money transfers: any money transfer submitted online and any request submitted during a personal visit to TEMPO Agency in Paris or one of the agents authorized by TEMPO France.

You confirm that all the data provided by you during registration and/or submission of transfer requests are correct, accurate, complete and, if applicable, relevant.

You are responsible for accuracy and authenticity of the data and information provided by TEMPO France within the framework of your registration and/or submitting your money transfer request. Please, check and, if necessary, double-check, the data entered by you.

In case of inaccuracy or rejection of the data and information provided by you, TEMPO France reserves the right to demand that you pay any additional expenses incurred by TEMPO France as a result of a refusal to perform the requested transfer, for compensation of all banking and/or administrative payment determined by any data you incorrectly specified.

Once your transfer request is submitted in accordance with the data and information provided by you – unless you have declared an intention to exercise your walkaway right, or right to amend your personal data – TEMPO France is not responsible for any hazardous consequences, which can arise from your request (financial loss, etc.).

In case you have revealed a mistake, which is highly improbable, in the document issued for your request, in particular, a mistake in the amount actually received by your recipient (see Examples 1 and 2 below), you shall immediately contact TEMPO France via Customer Support Service by one of the following methods:

Example 1: an excess amount was transferred to your recipient though you initially wrote off the amount that was specified in your initial request, without commissions (an illustrative example: you transferred to your recipient only 100 Euros, without commissions, but your recipient got 200 Euros, without commissions). 

Example 2: an lesser amount was transferred to your recipient though you initially wrote off the amount that was specified in your initial request, without commissions (an illustrative example: you transferred to your recipient 200 Euros, without commissions, but your recipient got only 100 Euros, without commissions)

Hereby you agree to always use the services offered by TEMPO France in relation to this Agreement, as well as any other legal provisions provided on TEMPO France’s website (please, see information on such pages as "Legal Information" and "Privacy Policy").

Hereby you agree to pay the due amounts under the transfer requests to the extent it deals both with the amount of such a transfer (the amount paid to your recipient, without commissions) and with the expenses related to this transfer request, which were approved (valid commission rates and applicable currency rates, see Art. 9 hereof) or were unforeseeable (additional expenses, such as described in the previous article).

Hereby you agree to never use the services offered by TEMPO France for performance of any illegal activities both individually and jointly with any third persons for the purpose of the prohibited transactions implementation.

TEMPO France reserves the right to make inquiries on any suspicious activity or in response to claims or information on violations, which related to you directly or indirectly. As the case may be, TEMPO France reserves the right to communicate your alleged suspicious activities to any competent body and provide all corresponding information on the specified transactions, including your personal data and personal data of your recipient. As the case may be, TEMPO France reserves the right to demand you to pay additional expenses determined by your transactions.

13. Security measures and communication

Hereby you accept an exclusive and joint obligation to observe the individual measures for ensuring safe storage of your login and password for TEMPO France’s website and provide transfer of your transfer request data to your recipient, as well as an exclusive and joint obligation to observe the individual security measures in relation to TEMPO France’s website (for example, if you open them on any public device or via Wi-Fi in a public place).

In your transfer request, TEMPO France specifies – besides other data – your request number, the exact amount, without commission, to be received by the recipient, the place where the specified recipient can obtain the funds, documents to be provided by your recipient (ID, etc.) to receive these funds, and an approximate period required by TEMPO France for the specified funds to be in possession of your recipient.

It is you who bears responsibility for sending your recipient – with the help of any safe means – the above-mentioned data (such as: a request number and the exact transfer amount, documents to be provided, the place and an approximate time of receipt of funds, etc.), which will be required by him/her to successfully receive your transfer. TEMPO France is not responsible for any undue transfer of the specified data to your recipient by you (erroneous or unsafe transfer).

Hereby you agree to interact with TEMPO France by e-mail or through its website. It does not prejudice your right to contact TEMPO France’s Customer Support Service with the help of other communication means under the circumstances specified in Art. 2, 5, 6, 10, 12 and 14.

14. Claims

In case of any claim, TEMPO France’s Customer Support Service will help you to find a fast and efficient solution as the customer's satisfaction is regarded as the main priority by TEMPO France.

For your claim to be considered, you should provide the following data: the precise subject of your claim, your transfer request number, and your full contact data for our employees to be able to contact you by any available means.

TEMPO France does its best to consider your claim immediately upon its receipt and, if the claim meets all the above-mentioned conditions, respond quickly to it, if possible, within 48 hours, by finding a solution, which allows settling the situation causing the problem, afterwards Tempo France will immediately inform you about the results of its work.

In case upon expiry of this period it fails to find a solution, you will receive a notification confirming receipt of your claim within a reasonable period (as a rule, within five (5) business days upon receipt of your claim), which serves as a confirmation of the fact that your claim is received, meets the requirements and is processed by TEMPO France’s Customer Support Service.

Your claim will be considered by the Customer Support Service within 30 business days upon receipt by any available means of (a) document(s) allowing TEMPO France to definitely identify you. A definite response will be sent to you by any of the available means within the provided period.

Before submitting your claim to the mediator, you should exhaust all the appellation means provided by TEMPO France (for example, contacting the Customer Support Service, receipt and consideration of the claim within the provided period).

In case a response sent by TEMPO France to you does not satisfy you, you can contact a mediator of the French Payment Institutions Association (AFEPAME) at the following address: 36 rue Taitbout - 75009 Paris (France).

To obtain any additional information, please, review the mediation charter signed by TEMPO France on December 11, 2014.

15. Archive of documents

TEMPO France reserves the right to store and archive on its servers within no more than five years all the documents transferred by you (including your IDs, correspondence and others) and all the documents related to money transfers (for example, all documents concerning your request, which were provided by you or TEMPO France, a confirmation issued by TEMPO France and related to your transfer request, responses of TEMPO France to all your questions, etc.).

At any time, you can send a written request to TEMPO France’s Customer Support Service to learn what documents related to you are present in its digital archives, as well as to review the content of the documents related to you, which are present in the specified archives, in a reasonable volume.

16. Intellectual Property

According to Art. 122-4 of the Code of Intellectual Property, any reproduction and distribution of the content of TEMPO France’s website, fully or partially, is performed according to the editor's preliminary, written and special consent.

The logo, trademarks and service marks, trade name and other names owned by TEMPO France are registered and/or used in France and some other countries. All other names, logos or marks specified on TEMPO France’s website are in possession of their corresponding owners.

In accordance with the judicial practice of France, hereby we communicate to you that TEMPO France prohibits anyone, fully or partially, to reproduce or copy this Agreement, its Confidentiality Policy and Legal Provisions.
The judicial practice implies that copying of legal information (such as legal provisions and general terms) of the websites of e-commerce testifies to economic parasitizing or, in other words, to unfair competition. Therefore, a claim for damages in the amount of the incurred costs related to editing of cribbed documents can be filed by TEMPO France against anyone (legal entity or individual), which acts notwithstanding any prohibition imposed by this document of TEMPO France.

17. Cookies

TEMPO France uses cookies for identification and tracking actions of its users, their use of its website and their preferences in relation to an access to the website. Accessing TEMPO France’s website, you automatically give your consent to use cookies of TEMPO France for a year, starting from your first visit, taking into account that this practice is required for duly providing services offered by TEMPO France, including money transfer services provided according to the user's express request.

The visitors of TEMPO France’s website who are not willing to use cookies shall configure their web-browsers in such a way that cookies should be disabled before they visit TEMPO France’s websites (to disable cookies in the web-browser in advance). However, the user risks subsequently being obliged to allow numerous exceptions, in particular, in the course of transfer of money transfer requests; in this connection, the user will not be able to obtain an access to a requested service or will encounter considerable problems, which can lead to non-performance of the requested money transfers.

18. Commercial partners

Any advertisements posted on TEMPO France’s website are offered to users by its commercial partners, who can embed any links to other websites and cookies into them. Their cookies allow an advertising server to recognize your device every time you view their advertisements and accumulate data related to you and other users of your device. This information allows advertising networks to offer you target advertising (i.e. advertising of products and services, which meet your interest to the highest possible extent).
This policy of data protection is applied to use of cookies by TEMPO France and in no case refers to use of cookies performed by any commercial partner of TEMPO France.

Besides, TEMPO France is not responsible for the content of the websites of its commercial partners, as well as for use of cookies by them. TEMPO France also assumes no responsibility for any possible issues related to security, viruses or exchange of e-mails beyond the websites registered by TEMPO France.
In case of any remarks in respect of the websites of commercial partners, please, contact directly the administration or owner of one or several websites, in relation to which you have any remarks.

19. Force-majeure circumstances (insurmountable circumstances)

Within this context, a force-majeure circumstance means an unexpected, unsurmountable circumstance not depending on the will of TEMPO France.  In this case, a force-majeure circumstance can legally release TEMPO France from its responsibility or obligations hereunder. In case TEMPO France is not able to perform its obligations in your respect (according hereto), due to any unsurmountable and unforeseeable circumstance, i.e. such a circumstance that does not allow it to process your money transfer, and that cannot be foreseen when the money transfer request is submitted – in other words, any circumstance beyond the control of TEMPO France (see the examples below) – TEMPO France will inform you, as soon as possible, and do its best to ensure the recovery of your funds not transferred to your recipient. Nevertheless, TEMPO France cannot be held responsible for violation of your instructions in case such circumstances arise after your money transfer request is accepted by TEMPO France for processing.

For example (this list is not exhaustive): (1) an unexpected change of any legal documents governing financial transactions and other issues indirectly related to them (a law, regulation, decree or another binding order issued by the state authorities) in France and/or the country of the recipient; (2) natural disasters destroying all means of electronic communication and/or banking transmission in France and/or the country of the recipient; (3) cancellation of a currency (in France and/or the country of the recipient); (4) unexpected international sanctions imposed on France and/or the country of origin; (5) unexpected inclusion of your name or the name of your recipient into one of the official lists issued by the competent authorities in relation to any financial transactions and legal issues in France and/or the country of the recipient; etc.

20. Entire agreement -Severability - Changes and amendments of the agreement

This Agreement and all references to other legal provisions separately included into its text (such as "legal provisions", "confidentiality policy") constitute an entire agreement between you and TEMPO France and supersede all the results of interaction, discussions, correspondence, arrangements, negotiations, agreements, mutual treaties and contracts previously concluded between you and TEMPO France in relation to their subject-matter.
In case one or several clauses hereof or other legal provisions separately included into its text (such as "legal provisions", "confidentiality policy") shall be recognized invalid, illegal or unenforceable by any judicial body or any other competent body, it cannot anyhow prejudice the entirety of the agreement between you and TEMPO France: the remaining clauses of the agreement remain fully valid, legal and enforceable.

TEMPO France reserves the right to recurrently amend, review, replace or extend this Agreement, as well as other legal provisions separately included into its text (such as "legal provisions", "confidentiality policy").
In case this Agreement and/or other legal provisions separately included into its text (such as "legal provisions", "confidentiality policy") are to be amended, fully or partially, after you have submitted your money transfer request in TEMPO France (in person or electronically), but before receiving a confirmation from TEMPO France concerning the above-mentioned request processing, this version is regarded as the last version, as of the specified date, and in French, which will be applied in relation to your request during its processing, unless there is a special notification sent by you to TEMPO France within a reasonable period on your desire to cancel your request.
Any person that is not a party to this Agreement (including all the above listed elements) concluded between you and TEMPO France can require solely fulfillment of the obligations stipulated hereby, including the recipient of your money transfer.

21. Transfer of the agreement as an assignable asset to any third person

In case TEMPO France or most of its assets shall be sold, or, which is more probable, TEMPO France ceases its operation (voluntary liquidation), or has to shut down its business (winding-up by the court), the agreement concluded between you and TEMPO France (including the elements specified in the previous article) is regarded as an asset to be assigned to a third person, irrespective of its being a member of the European Union, or acquired by such a third person.
In accordance with the agreement concluded between you and TEMPO France (the agreement including the elements specified in the previous article), TEMPO France reserves the right to transfer its rights and/or obligations, fully or partially, to any affiliated company or third persons at any moment, without your preliminary consent in case of transfer or assignment of its assets.
Correspondingly, hereby you agree that such a transfer may occur and preliminarily authorize any successor of TEMPO France to fulfill the agreement in accordance with the Agreement version and other legal provisions, which are valid as of this asset assignment.

22. Applicable law and competent jurisdiction

The contractual and non-contractual relations between TEMPO France and its users are governed by the French law. Any dispute and claim arising from such relations shall be considered in the jurisdiction of France. All the above-mentioned shall not prejudice your legal rights.

The only French courts regarded competent in relation of consideration of disputes related to TEMPO France and delivery of a verdict are the courts of the corresponding jurisdiction of the city of Paris (France) where the headquarters of Tempo France are located.

"Agreement" refers to the Client Agreement - General TEMPO and Conditions.
"customer", "user", "you" refers to a person who visits TEMPO France’s website, uses the services offered by TEMPO France and/or sends money transfer requests (including electronic transfers).
"recipient", "recipient" refers to a person specified as an end-recipient of the payment transferred by the customer.
"offered services" refers to the commercial offer of services of TEMPO France to its customers on the website edited, managed and used by TEMPO France and via advertisements.
"website of TEMPO France", "site of TEMPO France", "website edited by TEMPO France" refers to two URL-address edited, managed and operated by TEMPO France (http://www.tempo.eu.com/).
"online transfer", "e-transfer" refers to a money transfer request to the specified recipient, which is submitted electronically.
"transfer", "money transfer" refers to the entire transaction of transfer of funds, a request for which was submitted directly through a cash-office or electronically.
